These General Conditions of Hire apply to all contracts concluded with Transa Backpacking AG (‘Transa’) for all types of hire and test items. In all other respects, the General Terms and Conditions also apply without restriction to all hire contracts. Reference is made in particular to Section 19 of the General Terms and Conditions.
The contract is concluded between the hirer and Transa. The hirer must be at least 18 years of age. If the hirer is under 18 years of age, written consent must be obtained from their parent or guardian in order for a hire contract to be concluded.
The hire price for the agreed hire period is to be paid in advance when the hired item(s) is/are handed over. The hire price is calculated based on the number of days; Sundays and public holidays count in full. The hirer will not be charged for the day of collection if the hired item(s) is/are collected after 2 pm. Similarly, the hirer will not be charged for the day of return if it/they is/are returned before 2 pm. This excludes offers indicated separately.
Insurance is the responsibility of the hirer. By concluding the hire contract, the hirer confirms that they are sufficiently insured against risks arising from liability, accident and theft.
The hirer receives the hired item(s) in a clean condition. If the hirer has any complaints, they must be reported to the hire provider upon handover. The hirer must prove their identity by means of an official document (passport or ID card).
If the hired item(s) experience/s a fault during hire, the hire provider must be notified without delay and the hired item(s) returned to them. If the fault is due to an existing issue with the hired item(s), it/they will be exchanged where possible. If the hire provider cannot replace the hired item(s) with an equivalent, the hirer will be refunded for the unused hire period that they have paid for, less any costs owed by the hirer.
In principle, the hire provider shall accept reservations in person and by telephone. Reservations are binding for the hirer. If the item(s) is/are not collected and no reasons are given, the hirer will be charged CHF 25. Events that preclude collection or return (force majeure, extreme weather, illness, accident) are excluded. In this instance, notification must be given 24 hours before the hire period commences. If the hired item(s) is/are returned early, credit will only be given for full days of hire; parts thereof are chargeable.
The reserved item(s) will be kept by the store until closing time on the agreed date of collection. The item(s) will be re-released for hire from this point onwards; the customer will not be entitled to compensation.
The hire period can only be extended with the hire provider’s consent prior to the end of the ongoing hire period. The hire provider may refuse the extension without giving a reason.
The hirer is obliged to return the hired item(s) to the hire provider during store opening hours and prior to the end of the hire period stated in the hire contract. Costs arising from the late return of the hired item(s), and any consequential costs caused by this, shall be borne by the hirer. The hired item(s) and the accessories made available by the hire provider must be returned to the hire provider in full, clean and in an impeccable condition. Any cleaning undertaken by the hire provider will be charged on the basis of the actual cost incurred; a minimum fee of CHF 30 applies. This excludes sleeping bags, rain clothing and insulated clothing, as cleaning by the hire provider is included in the hire fee for these products. The hirer is automatically deemed to be in default, with no reminder issued, if the hired item(s) is/are returned late. An extra charge will be levied for the unit of time that exceeds the agreed hire period. Transa charges the hire rate as stated on the current list of hire prices for every day that the hired item(s) is/are overdue. In addition, a processing fee of CHF 20 is charged for every reminder. Transa will notify the authorities if the hired item(s) is/are not returned within 30 days of the end of the hire period. The right to assert further damages remains reserved.
The hire provider must inform the hirer of the proper use of the hired item(s) and the need to make personal adjustments to sports equipment. The hirer undertakes to use the hired item(s) carefully and properly. The hirer is responsible for all damage, including excessive wear and tear, arising from negligence or improper use. Sub-hire is forbidden. The hirer is obliged to wear appropriate protective clothing when using the hired item(s).
The hirer uses the hired item(s) on any roads, paths, sites, slopes and land at their own risk. The hire provider does not accept any liability and fully disclaims any liability for minor negligence. The hire provider’s exclusion and limitation of liability also apply to its vicarious agents/employees. The hirer shall use the hired item(s) at their own risk. The provision of the hired item(s) by the hire provider does not include training in the use of the products. As a result, the hire provider is not responsible for losses or damages due to the improper use of the hired item(s), non-compliance with standard safety measures or similar reasons.
The hirer is liable for any damage to the hired item(s), including accessories, that occurs during the hire period (especially due to a fall, vandalism, natural events, manipulation, transport-related issues or improper or inappropriate use). The hirer will be invoiced the value of repurchasing or replacing the hired item(s) or accessories in the event of its/their loss, theft or damage. Should the hirer state that third parties are responsible, the police must be notified of this immediately. If the hirer gives the hired item(s) to third parties, the hirer shall be responsible for any damage and consequential damage caused to or by the hired item(s) by third parties. The liability exists regardless of whether the hirer is using the hired item(s) themselves or whether it/they is/are given to third parties, either with the hirer’s permission or against their will.
If the hirer purchases a new product corresponding to the hired item(s) they have previously returned, they will be able to credit a maximum of two days’ hire fee towards the purchase of the new product. The hire of touring skis cannot be put towards purchases of crampons, stoppers or similar accessories. Hire days in the same season as the purchase are credited. The hire fee actually paid is credited and may only be put towards available products. Test skis sold at net prices are excluded.
The hire provider collects and processes the hirer’s personal data. This relates to personal data required to process the hire contract (e.g. the hirer’s first name, surname and address).
The collection and processing of the hirer’s personal data by Transa is explained in the Privacy Policy, which represents an integral component of the General Conditions of Hire. The Privacy Policy can be viewed at www.transa.ch/en/data-privacy.
Transa only uses hirers’ personal data where permitted by law. If Transa uses personal data for a purpose that requires the hirer’s consent in accordance with statutory provisions, Transa will ask the hirer for their express consent in each case. Once consent has been given, the hirer can revoke it after conclusion of the hire period and/or object to future use of their data.
Oral collateral agreements are invalid or are only valid if confirmed in writing by the hire provider.
