Version 24/01
The TransaCard terms and conditions (‘Terms and Conditions’) set out below apply to the issuing and use of the TransaCard and the resulting relationship between the person participating in the TransaCard programme and Transa Backpacking AG, Josefstrasse 53, 8005 Zurich (‘Transa’).
The TransaCard is a customer card issued free of charge by Transa to natural persons aged 18 or over and resident in Switzerland or the Principality of Liechtenstein. The TransaCard is issued only bearing the holder’s official
name – made-up names or pseudonyms are not permitted. The person issued with the card must use the address of their official place of residence and provide a valid email address. If these requirements are not met, Transa reserves the right to not issue a TransaCard or to block the TransaCard concerned.
The application for a TransaCard can be made in writing using the relevant application form or online at www.transa.ch/en/faq/transacard. The applicant will become a member of Transa’s customer loyalty programme (‘programme’) upon receiving or taking delivery of their TransaCard. Members are obliged to inform Transa of any changes regarding their contact details. Changes must be communicated in writing* to Transa’s customer service or amended by the cardholder themselves at www.transa.ch/en/account.
The member collects Transa points (‘points’) each time they make a purchase provided that they present their TransaCard when making a purchase in a Transa store. Collecting points for purchases made in the online shop requires members to be registered and logged in and to have their TransaCard stored in their online account.
Points earned are credited to the member’s customer account (‘account’). The relevant number of points credited is shown on the purchase receipt or in the online shop and is calculated on the basis of the net purchase amount (i.e. invoice amount including VAT and less any returns, return shipments and discounts). Points are usually credited at a rate of one Transa point per CHF 1. No points are awarded for gift cards purchases, delivery costs or flat-rate expenses. In cases of force majeure or technical failure, the crediting of points may be temporarily suspended without any replacement award.
The current points balance (‘balance’) is displayed on the receipt or in the online shop for each purchase and can be checked at any time at a checkout in a Transa store or in ‘My Account’ at www.transa.ch/en/account. The cardholder must report any errors in their balance to Transa within 30 days of their last purchase. Failure to do so will result in the credit being deemed accepted. Errors must be reported to Transa’s customer service*.
The cardholder will receive several stickers with a barcode showing the TransaCard account number. The cardholder can pass these stickers on to third parties, who can use them to collect points for the cardholder’s account or redeem the points collected in the account. These third parties are not entitled to any other benefits from the card programme, such as the customer magazine, partner offers, etc. The distribution of stickers to third parties is carried out at the cardholder’s own risk. Transa shall not be liable for points that are redeemed by third parties against the wishes of the cardholder. The cardholder should be aware that in the online shop points can only be collected and redeemed by the cardholder.
The points collected can be used by the cardholder as payment in a Transa store or in the online shop no earlier than the day after they are credited. A balance of 50 points is worth CHF 1. If the points balance does not cover the purchase, the card holder can pay the remaining amount using another payment method accepted by Transa. Collected points expire three years after they are credited. Points cannot be paid out as cash.
Transa shall inform the cardholder primarily by email about current benefits and other advantages of the programme. With the consent of the cardholder, Transa is also authorised to use the data provided to send information and offers from Transa that do not directly relate to the TransaCard programme (e.g. customer magazine, newsletter).
The Transa Backpacking AG Privacy Policy applies. The current version of the Policy is available at www.transa.ch/en/data-protection.
Transa points that have been misused, for example in connection with theft or loss of the TransaCard, cannot be replaced. Lost stickers/cards must be reported to Transa*.
Membership in the TransaCard programme can be cancelled by cardholders and by Transa subject to 30 days’ notice. Upon expiry of the notice period, all Transa points and entitlements arising from membership of the TransaCard programme shall expire. Transa must be notified* of cancellation in writing.
Transa reserves the right to amend these Terms and Conditions at any time. The current version is available at www.transa.ch/en/transacard. Cardholders will be notified of changes by appropriate means and, if the cardholder does not cancel their membership in the programme within 30 days of notification, the Terms and Conditions will be deemed to have been accepted.
If any individual provision of these Terms and Conditions is or becomes invalid in whole or in part, this shall not affect the validity of the remaining provisions. These Terms and Conditions and all legal relationships between cardholders and Transa shall be governed by substantive Swiss law excluding all provisions and rules pertaining to foreign and international law. The ordinary courts of law in the location of Transa’s head office shall have exclusive jurisdiction for all disputes arising from or in connection with these Terms and Conditions, the TransaCard and/or membership of the TransaCard programme.
